PART I: GENERAL WEBSITE USE & E-COMMERCE

1. Eligibility & Age Requirement

1.1 Minimum Age for Purchase. You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, to make a purchase on this website or participate in the Affiliate Program. While our coloring books and products may be suitable for children and teens, they must be purchased by a parent or legal guardian. By completing a purchase, you represent and warrant that you meet this age requirement.

1.2 Account Security. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree not to share your account access with third parties.

2. Products, Pricing & Zero Refund Policy

2.1 Digital Products. True Colors Coloring Books primarily sells digital products, including but not limited to downloadable PDF coloring books, interactive digital coloring experiences, and customized digital workbooks. Due to the nature of digital goods, which cannot be "returned" once downloaded or accessed, ALL SALES ARE FINAL.

2.2 Zero Refund Policy. WE MAINTAIN A STRICT ZERO REFUND POLICY ON ALL DIGITAL PRODUCTS. By completing a purchase, you acknowledge and agree that you are not entitled to any refund, exchange, or credit under any circumstances, including but not limited to: dissatisfaction with the content, failure to read product descriptions, or changing your mind.

2.3 Customer Satisfaction Exception. While we do not offer refunds, your satisfaction is important to us. If you experience a technical issue downloading your product, or if you feel the product did not meet the description, please contact us at support@truecoloringbooks.com. We will work with you in good faith to resolve the technical issue or, at our sole discretion, provide an alternative product or solution to meet your needs.

2.4 Pricing. All prices are subject to change without notice. We reserve the right to modify or discontinue any product at any time.

3. License & Restrictions on Use

3.1 Personal Use License. When you purchase a digital product from True Colors Coloring Books, you are granted a limited, non-exclusive, non-transferable, revocable license to download, access, and print the content solely for your personal, non-commercial use.

3.2 Prohibited Conduct. You strictly agree NOT to:
(a) Resell, redistribute, share, or upload our digital files to any third-party platform or website.
(b) Share your account access or download links with others.
(c) Engage in bulk purchasing for the purpose of resale or distribution.
(d) Modify, alter, or create derivative works from our coloring books or workbooks.
(e) Use our products for any commercial purpose, including in a clinical or therapeutic setting, without a separate commercial license agreement.

Violation of these restrictions constitutes copyright infringement and will result in immediate termination of your access without refund, and potential legal action.

4. Medical & Therapeutic Disclaimer

4.1 Not Healthcare or Therapy. True Colors Coloring Books, the Customization Station quizzes, and all associated workbooks are created by psychologists based on the SchemACT approach, but they are NOT healthcare, therapy, or medical services. Nothing on this website constitutes medical advice, psychological treatment, therapy, counseling, or any form of professional healthcare service.

4.2 Educational Purposes Only. All content, including personalized quiz results and customized workbooks, is for educational, entertainment, and self-reflection purposes only. They are NOT clinical assessments or diagnostic tools.

4.3 No Professional Relationship. Using this website or purchasing our products does not create a therapist-client, doctor-patient, or any other professional healthcare relationship between you and Bay Area CBT Center, Dr. Avigail Lev, or any of our staff.

PART II: AFFILIATE PROGRAM AGREEMENT

The following terms apply specifically to individuals who apply and are accepted into the True Colors Affiliate Program ("Program").

5. Nature of Affiliate Relationship

5.1 Independent Contractor. You are an independent contractor and NOT an employee, partner, joint venturer, agent, or franchisee of Bay Area CBT Center. You are solely responsible for your own taxes, insurance, and compliance with all applicable laws.

5.2 At-Will Participation. Your participation in the Program is entirely at-will. Either you or the Company may terminate your participation at any time, for any reason, with or without cause or notice.

6. Affiliate Commissions & Earnings

6.1 Commission Structure. The Program offers commission tiers based on performance. These tiers are guidelines and do not constitute a guarantee of specific earnings. The Company reserves the right to modify the commission structure at any time.

6.2 No Guaranteed Earnings. THE COMPANY MAKES NO GUARANTEES REGARDING THE AMOUNT OF INCOME YOU MAY RECEIVE. Your earnings depend entirely on your own effort, skill, and market conditions.

6.3 Tax Responsibility. You are solely responsible for reporting and paying all applicable taxes on earnings. The Company may issue tax forms (e.g., IRS Form 1099-NEC) as required by law.

7. Affiliate Conduct & Restrictions

7.1 FTC Compliance. You must clearly disclose your affiliate relationship with True Colors Coloring Books in all promotional content in accordance with Federal Trade Commission (FTC) guidelines.

7.2 Non-Competition & Non-Solicitation. While participating in the Program, you agree not to actively promote, market, or sell directly competing coloring book products on the exact same web pages, social media posts, or specific marketing campaigns where you are promoting True Colors products. Furthermore, you agree not to solicit, poach, or attempt to recruit other True Colors affiliates into competing programs.

7.3 Prohibited Marketing. You shall not: (a) make false or misleading claims about our products or potential earnings; (b) use spam, bots, or deceptive practices; (c) bid on trademarked terms ("True Colors Coloring Books", "Bay Area CBT Center") in paid search advertising without written permission.

8. Intellectual Property & Content Ownership

8.1 Content Created Within the Program. Any content you create specifically for or in connection with the Program (including videos, demonstrations, reviews, and social media posts created for Program accounts) shall be the exclusive property of Bay Area CBT Center. You irrevocably assign all rights in such content to the Company.

8.2 Confidentiality. You agree to keep all internal Program information, strategies, training materials, and earnings data of other participants strictly confidential.

PART III: GENERAL LEGAL PROVISIONS

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BAY AREA CBT CENTER, ITS OWNERS, DIRECTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, PURCHASE OF PRODUCTS, OR PARTICIPATION IN THE PROGRAM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Bay Area CBT Center and its affiliates from any claims, damages, losses, or expenses arising out of your breach of these Terms, your violation of any law, or your misuse of the website or products.

11. Dispute Resolution & Governing Law

11.1 Governing Law. These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.

11.2 Binding Arbitration. Any dispute arising out of these Terms shall be resolved by final and binding arbitration administered in San Francisco, California, in accordance with the rules of the American Arbitration Association.

11.3 Class Action Waiver. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
